Rejoice in the Rain Counseling PLLC and Lydia Anthony, LPC, are committed to helping you understand your patient rights—including (a) how to request medical records, (b) contact the state’s Executive Council, and (c) file a consumer complaint.

This notice has been written in accordance with the Health Insurance Portability and Accountability Act (HIPAA), House Bill 4224 (89th Regular Session), Section 181.105 of the Texas Health and Safety Code. If you have any questions about this bill, please visit the Council's Contact Us webpage.

SECTION A: REQUESTING MEDICAL RECORDS

You have the right to request a copy of your medical records (also known as healthcare, mental health, or clinical records), either for your own use or to be released to an outside party.

  • Current Clients: Please submit your request to me via your secure SimplePractice client portal.

  • Former Clients: If you do not have access to your portal anymore, reach out to our office below. Please include your full name, date of birth, and the nature of your records request. Requests may be subject to identity verification.

Q: How long will it take until I can expect a response? Our office usually responds within 24 business hours. If we are closed for holidays or scheduled time off, we will respond as soon as we return—never more than 14 days. We will let you know our return date through your client portal (for current clients) or by an automatic email reply. We work to process your records request as quickly as possible, but it may take up to 15 business days from the date we receive your request.

Q: Is there a possibility of my medical records request being denied? Yes, in some cases your request may be denied if the law does not allow us to share your records or if sharing them could cause harm. If we deny your request, you will get a written explanation within 15 business days. We will try to offer you helpful information, such as a summary or letter about your care, if we cannot provide the full records.

Q: What can I do in response to my request being denied? You can ask for a review of the decision by a licensed healthcare professional not involved in your care. To request a review, contact our office within 30 days of getting your denial letter. You can also file a complaint with our licensing board or with the Texas Attorney General’s Consumer Protection Division (see SECTION C for instructions).

Q: What if I want my records to be sent to my doctor, psychiatrist, etc.? We will get that taken care of for you after you sign a Release of Information form allowing the third party to view your records.

Q: Is there a fee for requesting my records? A standard processing fee of $25 may apply for requests involving extensive documentation.

SECTION B: CONTACTING OUR LICENSING BOARD

If you have questions or concerns about the licensure or professional/medical conduct of any licensed professional, you may contact their licensing board for more information or to share your concerns. Licensing boards exist to regulate professional services.

SECTION C: FILING A CONSUMER COMPLAINT

If you have concerns about our business practices or believe you have been treated unfairly, you have the right to file a consumer complaint with the Texas Office of Attorney General’s Consumer Protection Division. This office investigates complaints about unfair, deceptive, or fraudulent business practices in Texas.
